THE FOLLOWING DESCRIBES THE TERMS ON WHICH Seastar Hits OFFERS YOU ACCESS TO OUR SERVICES.
This User Agreement ("Agreement") is a binding contract between you and Seastar Hits and applies to your use of the Seastar Hits services and any related products available through Seastar Hits Internet Servers (collectively the "Service"). If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our Services.
By clicking on the "Sign Up" button and participating in any program offered by Seastar Hits, you agree to be bound by all the terms of this Membership Agreement including the privacy statement.
Updates to This Agreement.
This Agreement may be modified by Seastar Hits from time to time, with or without notice. Member accepts any modification by using the Service after the modifications have become effective. If the Member objects to any modification, the Members sole remedy is termination of the Members account by contacting our support staff.
The Seastar Hits Service:
The user agrees not to operate hardware or software designed to bypass the systems developed by Seastar Hits for the benefit of all the users. Seastar Hits members are strictly prohibited from artificially accumulating Page Views to their account through the use of (but not limited to) any device, program, software or robot designed to auto click or alter the surfing environment in any way other than it's intended form of use.
Members are not permitted more than one Account. Signing up to more than one account could result in member termination and loss of all site Page Views, banner Page Views, text Page Views, and any cash in member account balance.
When an account is set-up, the user agrees to provide current and accurate information. User agrees that, that information can be used by Seastar Hits to make contact with the user. You also agree that by submitting this application you are subscribing to our affiliate newsletters and that you give us the right to send you email announcements. Any inaccurate information may result in the users account being closed.
Information given in registration will not be sold or given to any third party without the users written permission, unless required to by law. Users agree not to collect or harvest any users information that may be on our internet servers.
Seastar Hits can not be held responsible for outages due to server issues, server outages due to maintenance, updating or resets.
Websites NOT allowed at Seastar Hits
* Sites found to violate these terms will have their page removed and all Page Viewsassigned to the page will be forfeited.
* Adult, Racism, Warez, illegal or any other unsuitable websites are not allowed on our network. Members who post unsafe websites will have their pages removed and all Page Views assigned to the page will be lost.
* Framebreakers - Don't add them!
* Multiple and/or Full screen pop ups, Popup Rotators, Exit pop-ups, one time pop-ups or any other pop up that opens a new browser window. Don't even THINK about adding them! They will be deleted upon discovery and all Page Views assigned to them lost forever. One popup will be permitted as long as it does not interrupt surfing. This will be at the sole discretion of the admin.
* Redirected URLs (Sites which load a completely new Url from a site currently being viewed. This does not include tracking or shortened Urls.
* Rotators must contain either disclosed links or admin checkability. Currently, Trker (Hitsconnect) and Pageswirl are admin checkable. NO Rotators Within Rotators.
* Seastar Hits splash pages or index page.
* Sites attempting to initiate non-requested/malicious downloads including but not limited to adware/spyware
* Page not found errors / or incorrect URLs.
* Banners must display correctly; be of a 468 x 60 format (or close); match the URL content; and the URL must meet the above requirements.
* Google Adsense ads should not be shown within framed pages as per Google TOS. Please do not submit google adsense sites for your benefit.
* Sites must contain 100% english language.
* PaytoPromote Sites (PTP), are subject to Admin discretion.
* No HYIP (High Yeild Investment Program).
* Surfing Links in attempt to earn Page Views from another exchange.
* No Investment Auto Surf sites
* No Investment Manual Surf sites that follow the x% daily paid to surf type model
* All sites are subject to the approval and discretion of Admin. All modified rotators, trackers, or domain controlled sites must be resubmitted for admin approval. Failure to do so may result in the loss of your account.
Information You Provide
You may not post, send, submit, publish, or transmit in connection with this site any material that:
*you do not have the right to post, including proprietary material of any third party;
*advocates illegal activity or discusses an intent to commit an illegal act;
*is vulgar, obscene, pornographic, or indecent;
*does not pertain directly to this site;
*threatens or abuses others, libels, defames, invades privacy, stalks, is obscene, pornographic, racist, abusive, harassing, threatening or offensive;
*seeks to exploit or harm children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
*infringes any intellectual property or other right of any entity or person, including violating anyone's copyrights or trademarks or their rights of publicity;
*violates any law or may be considered to violate any law;
*impersonates or misrepresents your connection to any other entity or person or otherwise manipulates headers or identifiers to disguise the origin of the content;
*advertises any commercial endeavor (e.g., offering for sale products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services) except as may be specifically authorized on this site;
*solicits funds, advertisers or sponsors;
*includes programs which contain viruses, worms and/or Trojan horses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications;
*disrupts the normal flow of dialogue, causes a screen to scroll faster than other users are able to type, or otherwise act in a way which affects the ability of other people to engage in real time activities via this site;
*includes MP3 format files;
*amounts to a 'pyramid' or similar scheme;
*disobeys any policy or regulations established from time to time regarding use of this site or any networks connected to this site; or
*contains hyper-links to other sites that contain content that falls within the descriptions set forth above.
Although under no obligation to do so, our Company reserves the right to monitor use of this site to determine compliance with these Terms of Use, as well the right to remove or refuse any information for any reason. Notwithstanding these rights, you remain solely responsible for the content of your submissions. You acknowledge and agree that neither Company nor any third party that provides Content to Company will assume or have any liability for any action or inaction by Company or such third party with respect to any submission.
Seastar HitsPage Views
A " Seastar Hits Page View" (hereafter referred to as "Page Views") has no monetary cash value. Page Views may be purchased, or earned by the member for using the Seastar Hits surfing module only.
Eligibility for Page Views
Page Views may be earned only in compliance with this agreement and other regulations posted on the Seastar Hits web site. In general, a Page View may only be earned or used through our Seastar Hits software surfing module, or any other method that Seastar Hits creates and/or approves.
Guaranteed Visitors
A Guaranteed Visitor for purposes of this agreement shall be defined as "each time any Seastar Hits website or Seastar Hits software application redirects a user to another members web site URL". It is the members responsibility to make sure the provided URL is accessible. To be guaranteed a visitor the member must have one unused Page View available and choose to trade that Page View for a Guaranteed Visitor. Seastar Hits makes no claim as to when visits will be received by the user. Seastar Hits can not be held responsible for third party hit trackers that may not record hits accurately. Seastar Hits statistics are final. Hits are views and are not viewers/visitors. Some sites may be shown multiple times to users.
No member shall be required to pay any dues to maintain an active Seastar Hits registration. If the member chooses to participate in optional fee-based services, the membership fee must be paid in advance to maintain continuous service.
Direct Sales
When a new member links to our network from a members web site through the HTML or programming code which Seastar Hits provides the member, the referring members ID number will be logged. Should that visitor become a new paid member, the referring member will be eligable for a percentage of that direct sale based upon the percentage set forth by Seastar Hits. No member will receive any Page View or bonuses for any referral.
LIABILITY
Seastar Hits, as well as its administrators, partners, and sponsors, can not be held responsible or liable for any damage or loss of information that may occur as a result of using Seastar Hits services. Members agree to use Seastar Hits services at their own risk. Seastar Hits advises the use of anti virus software when using any traffic exchange or otherwise surfing the internet.
Members have the right to cancel their Seastar Hits membership at any time. All existing referrals and/or Page Views and future earning potential through our affiliate program will be forfeited at the time of cancellation.
REFUND POLICY
Seastar Hits is in no way associated with Payza, or any other payment processor, and merely uses them to process payments for such things as membership fees, paid advertising, and purchasing Page Views.
Furthermore, Seastar Hits will not be held responsible or liable for any problems, damages, or losses that may occur with regard to a member's direct association with Payza (or other payment source) and any other aspects of their account. If any member cancels their Seastar Hits account, that member will be responsible for cancelling any upgrades or other subscriptions member may have with Seastar Hits through Payza. Member MUST go to Payza and cancel the subscription otherwise the monthly fees will continue. YOUR Payza account is YOUR responsibility!
Seastar Hits will not issue any refunds for Page Viewspurchased or for failure to cancel services. Note: Seastar Hits only uses Payza to pay out any commissions earned. If you do not have a Payza account that receives payments from us then you may use the amount for upgrade or other purchases on the site.
Cashout Policy
In order to cashout, you must have a valid First and Last Name entered in your profile as well as your Payza email address (this is how we pay you)
Your First and Last name MUST match your Payza account.
Your account must be in good standing and not suspended.
You must not have more than one account at this traffic exchange.
Activity & Requirements
In order to be considered an active member you must log into your account at least once every 90 days. Failure to log in within a 365 day period can be grounds for your account to be deleted.
Your relationship to Seastar Hits
Your relationship to Seastar Hits is one of an independent contractor and/or customer. No employee-employer relationship is created by your use of the Service. You do not have any obligation to refer new members to the Seastar Hits Program. Seastar Hits HAS NO OBLIGATION TO OFFER THE SERVICE OR OTHER PROMOTIONS TO YOU.
While Seastar Hits may take measures to prevent offensive information, the user acknowledges that any content found on our servers may not be controlled by Seastar Hits, and Seastar Hits can not be held accountable for it. However, the user agrees not to use Seastar Hits to promote or advertise any of the following material. Pornographic, Links or banners to pornography, Adult Content, Explicit, Racial, Hate, Illegal, SPAM, Auto-Surf Software, or any other material that may be offensive, harmful, hurtful, illegal or unethical.
Users will conduct themselves in appropriate manner and will not manipulate any of the site to gain Page View or access to unauthorised areas. Also, Seastar Hits does not allow the use of auto-surf software/hardware (etc.) to gain Page Views. Anyone caught using or distributing it will have their account terminated.
The user agrees not to hold Seastar Hits responsible for any content, links, advertisements, site malfunctions, miss-directions or any other events that may cause harm mentally, physically or to property.
You agree that Seastar Hits, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Seastar Hits believes that you have violated or acted inconsistently with the letter or intent of this agreement.
Seastar Hits may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this agreement may be effected without prior notice, and acknowledge and agree that Seastar Hits may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Seastar Hits shall not be liable to you or any third-party for any termination of your access to the Service. Again, it will be your responsibility to cancel any subscriptions you have with Seastar Hits by logging in to your Payza account and manually cancelling the subscription from your account there.
Dealings with advertisers are done at your own risk and Seastar Hits can not be held liable for any advertisers actions.
You agree to maintain a valid email address and your account is only activated once you have verified your email address by clicking a link in an email sent to you. By doing so you are bound to accept email from Seastar Hits which will include system messages and marketing information. This is an opt-in service and you can choose to receive emails or not by editing your profile. Any user threatening or reporting Seastar Hits for sending spam or UCE or Unsolicited Commercial Email will have their account terminated. Further more all legal costs and compensation will be sought through the courts for any loss of time or reputation.
Seastar Hits is an honest marketing business supported by appropriate privacy statements, terms and conditions, user agreements, business practices and an excellent reputation in the trade that it will protect through all means available. This benefits you, your business, and the online promotion and marketing businesses in general.
By continuing to use this site you are bound by this agreement and you agree that you will keep all information provided by this site confidential. You are not allowed to copy or comment or take any action that may devalue the sites service and accept any damages or costs thereof such breach including any agent or company that you may be associated with.
All headers, graphics, logo's, and site name are copyrighted. You may NOT use them without Seastar Hits written permission. You are permitted to use the splash pages and banners in the promotion of your referral campaign. Seastar Hits links MUST remain intact.
Spam/UCE/
Direct reference of ANY domain owned by Seastar Hits in ANY email is STRICTLY PROHIBITED. This includes, but is not limited to, your Seastar Hits affiliate URL This is sufficient grounds for immediate Termination of your Account.
One Account Per Member
Only one account per person is allowed and strictly enforced! We have coded a number of safeguards into the system to prevent multiple accounts.
Member Statement:
I have thoroughly read and understand the Seastar Hits terms and conditions. In joining and/or purchasing a Seastar Hits membership I agree to said terms and conditions.
